Arkansas Construction Law

The Overton Firm represents all segments of the construction industry nationally, regionally and locally to resolve disputes about construction performance.

We regularly work with manufacturers, architects, engineers and construction professionals addressing not only building performance and causation issues but also practical and cost effective solutions. Utilizing an in depth understanding of Building Science, we help clients propose real world solutions to building performance issues without expensive and unjustified enhancements.   Our core competencies also include early dispute resolution and targeted assembly and evaluation of relevant construction documentation as compared to "as built" conditions.

We have extensive experience in most facets of the residential and commercial construction industry and applies this experience in handling cases and items such as:

  • Payment Issues
  • UCC Claims and Filings
  • Materialmen and Mechanic’s Lien Filing and Defense/Removal
  • Bond Claim Filing and Litigation
  • Retainage Collection and Litigation
  • Trust Fund Statutes and Legislation
  • Design Defect Claims and Litigation
  • Changes and Delays in Construction
  • Bid Mistakes and Protests Claims
  • Foundation & Structural Claims
  • Breach of Contract Claims
  • Residential Construction Liability Claims
  • Mediation & Arbitration of Construction Disputes

We have been increasingly involved in handling issues with clients in ADR disputes, as well as filing and/or defending claims under the Arkansas Mechanic’s Lien Statutes and we are regularly asked to participate in educational seminars to Builders, Contractors, Sub-Contractors and Suppliers to strengthen their knowledge of procedures available to collect payment for work and to protect their lien rights.
